Frequently Asked Questions
When can I be considered a large holder in Spain?
A large holder is an individual or legal entity that owns more than 10 residential properties or a total built-up area of 1500 m2, dedicated to housing (excluding garages, premises, storage rooms). However, each community can modify the threshold of properties to be considered a large holder. For example, in Catalonia, one is considered a large holder if one owns more than 5 properties dedicated to housing in stressed areas.
What are the implications of being a large holder in Spain?
A large holder has greater limitations when it comes to setting the rental price of its properties. You will have to choose the lowest price between the reference index and the updated price of the last rental of the property in the last 5 years. It also has greater limitations when an eviction is to be carried out.
Is it convenient to create a holding company in Spain?
Corporate rental income is taxed at a rate of 23%. However, it will depend on the tax rate of your income tax return and your other income whether or not this is suitable for your particular situation. In addition, this income will be of the company, if you want to withdraw it for your personal use and enjoyment, you will have to distribute a dividend and pay again in your Renta between 19 and 28% extra… It may also be convenient to have a company for other tax purposes, limitations of liability, important tax reductions from a certain number of properties dedicated to rent or to avoid rental restrictions against local laws… each case is unique and you should inform yourself with your advisor to know the details of your situation. Can I rent my apartment by rooms in Spain?
Yes, it is completely legal to rent a house by the room. However, these contracts are not governed by the LAU (Ley de Arrendamientos Urbanos) but by the civil code. In addition, it has certain advantages such as higher profitability, but also disadvantages in terms of taxation, management and the passing on of expenses such as water, electricity, gas, etc.
Can I rent my apartment by days in Spain?
Yes, you can rent your apartment for days as long as you have the corresponding tourist rental license or corresponding communication in your municipality according to the regulations of your Autonomous Community. In some areas it is easy to obtain, but there are other areas where licenses are limited, suspended or no longer issued.
How is my rental income taxed in Spain?
The taxation of rental income will depend on several factors such as the legal form in which it was acquired (individual or company), the type of property (premises or dwelling) and the use to which the rental is to be put (habitual residence, dwelling or use other than as a dwelling).
Depending on the case or possible combination thereof, the property may be taxed in one way or another and benefit from possible reductions.
Also the status of the owner, as for example in large holders, may affect taxation.
It is advisable that you seek expert help to ensure that your taxation is optimal. In Inmo Empire Real Estate we are experts in property management and we can help you.
How can I calculate the profitability of a property in Spain?
The calculation of the profitability of any investment is calculated by adding the total net income that we will obtain annually from it in proportion to its acquisition cost. However, along with the acquisition cost, we must consider all associated costs, not just the purchase price. These costs are usually the ITP (or non-deductible VAT), notary costs, Land Registry and other possible charges that the property may have.
We must also avoid making the mistake of not including recurring costs and taxes when calculating the net annual income that we will obtain from the investment.
In Inmo Empire Real Estate we are specialized in the optimization of our clients’ real estate assets. We can help you minimize both recurring costs and the taxation of the net returns obtained. Contact us!
