Should I sell my property with VAT or with ITP in Spain?
In general, any property must be sold for ITP unless it can be considered as a new construction because it has been recently refurbished and fulfilled certain requirements or the transfer is between businessmen or professionals. In such cases, VAT should be applied to the sale of the property.
It is very important to take into account and consider this detail before any real estate transaction as it can mean a great cost or a great saving in the operation.

Do I buy the property with VAT or with ITP in Spain?
In most cases this decision does not depend on the buyer but on the selling party. However, if you have a choice, it is very important to bear in mind that there are situations in which it is important to give special importance to this fact. If we have, for example, an economic activity of real estate development, we could benefit from a reduced ITP of 3% instead of the standard 10% applied to most operations and in case of closing the operation with VAT, this could be deductible and thus save the totality of this cost.
What documentation do I need to buy a apartment in Spain?
The documentation required to purchase a property may vary depending on the situation of the property (such as whether it has encumbrances or not) and the personal situation of each of the parties (if mortgages exist or have to be requested for example), but in general it is as follows:

- Buyer’s ID card.
- Reservation document of the property (if any).
- Signed deposit document and proof of transfer (if any).
- IBAN of the buyer and seller with which the deposit was paid/collected and with which the rest of the amount is to be paid/collected if different.
- Simple note of the property to verify the charges and affectations of the same one, real ownership and to verify the characteristics of the property.
What documentation do I need to sell an apartment in Spain?
The documentation required to purchase a property may vary depending on the situation of the property (such as whether it has encumbrances or not) and the personal situation of each of the parties (if mortgages exist or have to be requested for example), but in general it is as follows:

- Last payment of IBI (Real Estate Tax).
- Deed of purchase of the property registered in the corresponding land registry.
- Simple note of the property.
- Certificate of Habitability.
- Energy certificate.
- ITE updated and up to date.
- Certificate of being up to date with payments issued by the property manager.
What are the steps to follow when buying a property in Spain?
The steps to follow in the purchase of a property may vary depending on the particular situation of each case, but in general they are as follows:

- Signing and payment of the earnest money contract.
- Compilation of the necessary information and documents.
- Mortgage application and acceptance of the mortgage by the bank (if necessary).
- Signature before a notary and payment of the agreed amount.
- Payment of real estate and notary fees.
- Payment of ITP or VAT. VAT is usually paid together with the amount of the purchase, although there are situations in which it is paid by the buyer due to reverse charge.
- Registration of the deed of sale in the corresponding land registry.
- Withdrawal of deeds from the registry and payment of the corresponding fees.
What is the average brokerage commission for real estate transactions in Spain?
The average commission in the Spanish market for the intermediation of real estate transactions is 5% of the value of the property. However, more economical options can be found nowadays.
